ORDINANCE


AN ORDINANCE RELATING TO AND PROVIDING FOR MOTOR VEHICLE LICENSES, FEES AND REGULATIONS.


BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF BROWN ING, MISSOURI, AS FOLLOWS:



No person residing in the City of Browning who is an owner or operator of any motor vehicle shall use, drive or operate any such motor vehicle within the City unless a license is first obtained therefor from the City Collector; provided, however, that this section shall not apply to any resident of the City who uses any motor vehicle exclusively outside of the City.



The term "motor vehicle" as used herein means any self-propelled vehicle not operated exclusively upon tracks, except farm tractors. "Owner" as used in this section means any person, firm, corporation or association, owning or renting a motor vehicle orhaving the exclusive use thereof under lease or otherwise for a period greater than ten days successively. "Person" includes a firm, corporation, partnership or association. "Resident" as used herein means any person who lives within the corporate limits of the City of Browning, Missouri or who shall be here for a period of more than thirty days successively and during said time shall have a place of abode or residence within the corporate limits of the said City for a period of thirty days successively.



The license fee for the license required for each self propelled motor vehicle including motorcycles or trailers by this article shall be as follows:

Trucks, including pick-up trucks:

Less than 2 tons $3.50 per year.
2 tons or larger $4.00 per year.

All other motor vehicles, motorcycles or trailers

Less than 12 horsepower $2.50 per year.
12 horsepower or more $3.00 per year.


The license fee prescribed by this section shall be due and payable on or before January 1st for all years beginning in 1999.


All licenses issued pursuant to this article shall expire on the 31st day of December following the date of issuance, regardless of the date on which the same may have been issued.



Before a license is issued the applicant shall convince the City Collector that all personal taxes due and owing the City by applicant have been paid. The applicant shall at the same time file a written application for the license setting out a brief description of the motor vehicle, giving the motor number, the type of body and the current license number of the State of Missouri. The applicant shall show the Collector the statement of the County and State Collector of personal taxes given him by Collector showing the number of motor vehicles owned by applicant. After compliance with this section and tender of the license fee, the City Collector shall issue a license to the applicant.



No license issued hereunder for any motor propelled vehicle or trailer shall be assigned.



(a) The City Collector shall, at the time of payment of the license fee herein provided for the issuance of a license therefor, deliver to the person receiving such license a decal adhesive license which shall be affixed to the lower right hand side (passenger side) of the windshield and shall thereafter be kept and displayed at all times during the license year.


(b) The decal license shall have printed thereon the number of the license, the words "Browning, Missouri" and the numeral indicating the year.


(c) All license decals shall be numbered in each year consecutively, beginning with the number "1" in 1999.


(d) All license decals shall be of such color, each year, as shall be designated by the Board of Alderman, but the same color shall not be used consecutively.


(e) The expense of procuring license decals shall be borne by the City.



Should any person fail to purchase a license as provided hereunder and becomes delinquent, on the purchase of a license, in addition to the cost of the license, such applicant shall as a penalty at the time the license is purchased pay the additional sum of $1.00 per month for each month the license is delinquent.


Any person failing to secure a license as herein provided or who shall violate any of the sections of this ordinance shall be deemed guilty of a Class C misdemeanor subject to the penalties and enforcement procedures set forth in Ordinance No. 233.


That all ordinances and parts of ordinances in conflict herewith are hereby repealed effective December 31, 1998.

That this ordinance shall be in full force and effect from and after its passage.
