ORDINANCE
AN ORDINANCE AMENDING ORDINANCE NO. 230 OF THE CITY OF BROWN ING, MISSOURI, WHICH ORDINANCE IS ENTITLED AN ORDINANCE ADOPTING HOUSING REHABILITATION PLAN FOR THE CITY OF BROWNING, MISSOURI.
WHEREAS, City of Browning passed Ordinance No. 230 by act of its Board of Alderman on September 3,1996; and
WHEREAS, after a review of the program established in Ordinance 230 was conducted to determine if changes or refinements are needed, an amendment of a portion of the wording in Exhibit A of said Ordinance No. 230 is necessary to clarify the intent of the original ordinance.
BE IT ORDAINED BY THE BOARD OF ALDERMAN OF THE CITY OF BROWN ING, MISSOURI, AS FOLLOWS:
SECTION I: Ordinance No. 230, Exhibit A, Steps in Process, Numbered paragraph 4 is amended to read as follows:
4. The building inspector will then prepare a preliminary inspection report listing all the required and allowable work and the method as how the work will be done. The preliminary inspection report will be followed by a list of specifications and cost estimate as prepared by the housing inspector. The specifications and detailed description of the work to be completed will be gone over carefully with the homeowner and occupant, with them signing an affidavit of service certifying that they understand what will be rehabbed on their structure. Also at that time, the homeowner must provide a written verification of payment of municipal, township and county real property taxes on the property to be rehabilitated and such is required prior to proceeding any further with the process of adminis tering the grant on the particular site. Failure to provide written verification of payment of said taxes at that time shall be deemed a withdrawal of the application by the applicant.
SECTION II: Ordinance No. 230, Exhibit A, Steps in Process, Numbered paragraph 10 is amended to read as follows:
10. When the work is complete, the rehabbed house will be inspected by the building inspector. Prior to or during that inspection the homeowner will provide written verification of payment of all outstanding municipal, township and county real property taxes to
the building inspector. If all work conforms to the specifications and if written verification of payment of taxes is provided by the home owner, the rehabilitation administrator will process payment. At the final inspection and before a payment request, the contractor must present his total bill, lien waivers and any lien waivers from the subcontractor.
SECTION III: Effective Upon Passage
This Ordinance shall be in full force and effect from and after its date of passage. PASSED AND APPROVED this 2nd day of March, 1998.
