ORDINANCE


AN ORDINANCE RELATING TO AND PROVIDING FOR THE PURCHASE OF

REAL PROPERTY OWNED BY LYNDA SLEETH AND BY DARRELL WATTENBERGER

IN THE CORPORATE LIMITS OF THE CITY OF BROWNING, MISSOURI, BY PAYING

BACK AND THE CURRENT 1997 PROPERTY TAXES ON SAID PROPERTY FOR THE

COUNTY AND TOWNSHIP AND BY FORGIVING THE BACK AND CURRENT (1997)

CITY OF BROWNING PROPERTY TAXES ON SAID REAL PROPERTY AND BY

FORGIVING A CLEANUP BILL FOR DANGEROUS CONDITIONS CLEANED UP BY THE

CITY AND PRESCRIBING AMENDMENTS TO THE BUDGET ORDINANCE.


WHEREAS, RSMo. §79.390 allows the City of Browning to purchase real estate for parks and RSMo. §90.010 allows the City of Browning to purchase real estate for parks and pleasure grounds and RSMo. §67.755 allows the City of Browning to purchase real estate for public recreation facilities and RSMo. §88.667 allows the City of Browning to purchase real estate for public squares and RSMo. §79.390 allows the City of Browning to purchase other necessary public buildings, and the City of Browning desires to do so with the dilapidated properties of Lynda Sleeth and Darrell Wattenberger;


BE IT ORDAINED BY THE BOARD OF ALDERMAN OF THE CITY OF BROWNING, MISSOURI, AS FOLLOWS:


Section 1: The City of Browning, Missouri, shall purchase from Lynda Sleeth, a single person the following described tracts of real estate in the corporate limits of the City of Browning in Linn County, Missouri:




Section 2: The City of Browning, Missouri, shall purchase from Darrell Wattenberger, a single person the following described tract of real estate in the corporate limits of the City of Browning in Linn County, Missouri:



Section 3: That the purchase price for the each of the above tracts of real estate is as follows:




Section 4: That upon receipt of a General Warranty Deed by the landowners described in Section 1 and 2, the City shall record such at the City's expense and shall pay the consideration stated in Section 3 herein.

Section 5: At the City Council meeting on February 3, 1997, a proposed budget for fiscal year 1997 was submitted and duly reviewed. Motion was made & second to approve budget as submitted and motion carried by unanimous vote of the council. Said budget is hereby amended to reflect the fact that the purchase price for the real estate described above in Sections 1 and 2 shall be deleted from General Fund unbudgeted funds and said amount shall be added to Miscellaneous Item for purchase of these properties.


Section 7: The Mayor and City Clerk are hereby authorized to sign such documents and the City Treasurer is hereby authorized to issue such warrants and make such payments as are necessary to effectuate the terms of this ordinance.

Section 8: This ordinance shall be in full force and effect from and after its date of passage.
