ORDINANCE
AN ORDINANCE RELATING TO AND PROVIDING FOR THE PURCHASE OF
REAL PROPERTY OWNED BY LYNDA SLEETH AND BY DARRELL WATTENBERGER
IN THE CORPORATE LIMITS OF THE CITY OF BROWNING, MISSOURI, BY PAYING
BACK AND THE CURRENT 1997 PROPERTY TAXES ON SAID PROPERTY FOR THE
COUNTY AND TOWNSHIP AND BY FORGIVING THE BACK AND CURRENT (1997)
CITY OF BROWNING PROPERTY TAXES ON SAID REAL PROPERTY AND BY
FORGIVING A CLEANUP BILL FOR DANGEROUS CONDITIONS CLEANED UP BY THE
CITY AND PRESCRIBING AMENDMENTS TO THE BUDGET ORDINANCE.
WHEREAS, RSMo. §79.390 allows the City of Browning to purchase real estate for parks and RSMo. §90.010 allows the City of Browning to purchase real estate for parks and pleasure grounds and RSMo. §67.755 allows the City of Browning to purchase real estate for public recreation facilities and RSMo. §88.667 allows the City of Browning to purchase real estate for public squares and RSMo. §79.390 allows the City of Browning to purchase other necessary public buildings, and the City of Browning desires to do so with the dilapidated properties of Lynda Sleeth and Darrell Wattenberger;
BE IT ORDAINED BY THE BOARD OF ALDERMAN OF THE CITY OF BROWNING, MISSOURI, AS FOLLOWS:
Section 1: The City of Browning, Missouri, shall purchase from Lynda Sleeth, a single person the following described tracts of real estate in the corporate limits of the City of Browning in Linn County, Missouri:
a) Lot Nine (9), in Block Seventeen (17), in the Original Town (now City) of Browning, Missouri
b) Lot Six (6), in Block Seventeen (17), in the Original Town (now City) of Browning, Missouri, except the West Eight (8) inches of the North Seventy (70) feet thereof
Section 2: The City of Browning, Missouri, shall purchase from Darrell Wattenberger, a single person the following described tract of real estate in the corporate limits of the City of Browning in Linn County, Missouri:
a) Lot Five (5), in Block Seventeen (17), in the Original Town (now City) of Browning, Missouri
Section 3: That the purchase price for the each of the above tracts of real estate is as follows:
a) The City of Browning will pay all back taxes to County and Township as well as the 1997 taxes to the County and Township.
b) The City shall waive any back taxes or current 1997 taxes for the Municipal property taxes levied by the City.
c) The City shall forgive any obligation by Darrell Wattenberger to pay his half and by Lynda Sleeth to pay her half of a $80.50 bill incurred by and expended by the City for cleanup of dangerous conditions on the aforementioned properties.
Section 4: That upon receipt of a General Warranty Deed by the landowners described in Section 1 and 2, the City shall record such at the City's expense and shall pay the consideration stated in Section 3 herein.
Section 5: At the City Council meeting on February 3, 1997, a proposed budget for fiscal year 1997 was submitted and duly reviewed. Motion was made & second to approve budget as submitted and motion carried by unanimous vote of the council. Said budget is hereby amended to reflect the fact that the purchase price for the real estate described above in Sections 1 and 2 shall be deleted from General Fund unbudgeted funds and said amount shall be added to Miscellaneous Item for purchase of these properties.
Section 6: The real estate herein purchased shall be used for any of the purposes set forth in RSMo. 79.390,
90.010, 67.755 or 88.667.
Section 7: The Mayor and City Clerk are hereby authorized to sign such documents and the City Treasurer is hereby authorized to issue such warrants and make such payments as are necessary to effectuate the terms of this ordinance.
Section 8: This ordinance shall be in full force and effect from and after its date of passage.
