BILL NO. ORDINANCE NO. 167
AN ORDINANCE PROVIDING FOR THE BROWNING MUNICIPAL COURT AS A DIVISION
OF THE LINN COUNTY CIRCUIT COURT AND FOR PERSONNEL RELATED THERETO.
Be it ordained by the board of aldermen of the city of browning, Missouri, As follows:
Section 1: Ordinance Nos. 131 dated July 3, 1973 and 164 dated January 30, 1978, are repealed.
Section 2: This ordinance is to coordinate ad define responsibilities and fees for the legal business of the City, including operation of the Court and jurisdiction over municipal ordinance violations.
Section 3: Browning, Missouri municipal ordinance violation cases shall be heard and determined by Associate Circuit Judges as provided by Section 479.040 RSMo, as amended 1978.
Section 4: CITY ATTORNEY.
A. It shall be the duty of the City Attorney to prosecute and defend in behalf of the City all suits in which the City is a party. to advise the Mayor, Marshal or any member of the Board of Aldermen on any questions of law in which the City is interested, and to do all the legal business for the City.
B. For cases appealed from the judgment of the Associate Circuit Judge, to the Circuit Court or to a higher Court, the Board of Aldermen shall allow to the City Attorney a reasonable fee for attending to the same in each of said courts, and for all other legal work also reasonable compensation.
Section 5: CITY MARSHAL.
A. The City Marshall shall be Chief of Police, and shall at all times have power to make arrests, or order the same with proper process, for any offense against the laws of the State, or ordnance of the City, by day or night, and bring the offenders to troa; before
all cases where an offense shall be committed or attempted to be committed in his presence, and to summon aid to assist in making arrests; and, if any person shall refuse to render such aid when so requested by the Marshal, or his deputy, he shall be fined upon conviction thereof in the sum of not less than Five nor more than Twenty-five Dollars.
B. If requested to by the Associate Circuit Judge, the Marshal shall collect and receipt of all fines, penalties, fees and costs adjudged by the Associate Circuit Judge or this ordinance, and immediately pay said fine or penalty to the City Treasurer, remit said costs to the State Treasurer and retain the fees due to the Marshal.
C. It shall be the duty of the Marshal to see that good order and quiet is preserved, in compliance with the law and ordinances governing the City.
