BILL NO. 336 ORDINANCE NO. 157
AN ORDINANCE PROVIDING FOR TRIMMING OF TREES AND CUTTING OF WEEDS AND
GRASS WITHIN THE CITY OF BROWNING, MISSOURI.
Be it ordained by the board of aldermen of the city of Browning, Missouri, as follows:
SECTION 1: It shall be the duty of any person or corporation own ing or controlling any lot or tract of land abutting on any street or alley or sidewalk upon which trees shall be standing which extend over such street, alley, sidewalk, or in front of, or along which any trees shall be maintained in any street or alley between the curb line and the property line on such street or alley, to trim such trees to a height of at least fifteen feet; provided that where such trees fork, said forks or prongs may be trimmed to a height of at least fifteen feet, and provided that this section shall not apply to young or small trees which would be materially injured by such trimmings; any person or corporation
who or which violates this section shall be deemed guilty of a misdemeanor.
SECTION 2: No person, firm, co-partnership or corporation, being the owner, occupant or having charge of any lot or tract of land within the City of Browning shall allow or permit any grass or weeds to grow or remain on said lot or tract of land or outside of and in front of or alongside of the said lot or tract of land, between the outside line of
the same and the center line of the street adjoining said lot or tract of land, to or at a greater height than twelve inches nor allow or permit any dead grass or weeds to stand or remain on any such lot or tract of land and all grass and weeds when cut on any such lot or tract of land shall be cut to a height of not greater than four inches.
A. Whenever weeds or grass, in violation of the foregoing, are allowed to grow on any part of any lot or ground in the City of Browning, the owner of the ground, or in the case of joint tenancy, tenancy by the entireties or tenancy in common, each owner thereof, shall be severally and jointly liable.
B. The City Marshall shall give a hearing after ten (10) days' notice thereof, served either personally or by United States mail to the owner or owners, or his or their agents, or by posting such notice upon the premises, and may thereupon declare the weeds or grass to be a nuisance and order the same to be abated within five (5) days.
C. In case the weeds and grass are not cut down and removed within the said five day period, the Marshal shall notify the Alderman directing street maintenance, who shall have the weeds and grass cut down and removed, certifying the costs of the same to the City Clerk who shall cause a special tax bill therefor to issue against the property to be collected by the City Collector together with other taxes assessed against the property.

SECTION 3: This Ordinance shall be in full force and effect from and after its passage and approval.
